II – GENERAL PROVISIONS

2.1. The website http://www.altgust.ro is owned by ALTGUST S.R.L., a Romanian legal entity headquartered in the Municipality of Iasi, Vulpe Street, No. 9, Room No. 2, Iasi County, Romania, with telephone number 0740247770 and email address: contact@altgust.ro, registered with the Trade Register under no. J22/2866/20.09.2023, having VAT number 48807073.

2.2. The use of the website is only permitted to users over the age of 18 years old who accept these Terms and Conditions, as well as the other relevant policies presented on the site.

2.3. If you do not agree with these Terms and Conditions or with any part of them, please do not use the site.

III – DEFINITIONS

Website: represents the domain http://www.altgust.ro and its subdomains

Company/We: ALTGUST S.R.L., a Romanian legal entity headquartered in the Municipality of Iasi, Vulpe Street, No. 9, Room No. 2, Iasi County, registered with the Trade Register under no. J22/2866/20.09.2023, having VAT number 48807073.

User/Users: Any individual over the age of 18, or legal entity, or any legal entity that navigates, reads, uses, or creates an account on the site and/or subscribes to the newsletter.

Client/Buyer: Any user who has placed and finalized an order on the website www.altgust.ro

Order: an electronic document that intervenes as a form of communication between the Company and the Client, through which the Client communicates to the Company his intention to purchase Goods from the site.

Goods: any product or service to be provided by the Company to the Buyer as a result of the Contract concluded.

Contract: The distance agreement between the User and the Company, without the simultaneous physical presence of the User and the Company, in accordance with these Terms and Conditions.

Personal data: Any information regarding the User that allows his direct or indirect identification, including, but not limited to, name, surname, mailing address, email address, phone number provided by the User for the purpose of placing an order on the site, transmitting opinions and suggestions, publishing materials, or for any other purposes.

Consent to the processing of personal data: Any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which he accepts, by a statement or by a clear affirmative action, that personal data concerning him are processed.

Intellectual Property Rights: all intellectual property rights, copyright and related rights, database rights, design rights, patents, trademarks, and domain name registrations for any of the foregoing.

IV – USE OF THE SITE

By using this site and/or placing any orders for products through it, you agree to:

4.1. Not use the site abusively, illegally, fraudulently, or harmfully, and not to conduct systematic or automated data collection activities without the Company’s consent.

4.2. Not to place any false or fraudulent orders. If we have reasonable grounds to believe that you have placed such an order, we reserve the right to cancel the order and inform the competent authorities.

4.3. Provide correct and accurate contact and order delivery details. Also, you consent to us using this data to contact you if necessary (see our Privacy Policy).

V – PLACING AN ORDER

5.1. The information provided in the Terms and Conditions and the policies on this site does not constitute an offer to sell, but an invitation to offer. There will be no contract between the User and the Company in connection with any product until the Client’s order is expressly accepted by us.

5.2. To place an order, you must follow the online purchase procedure and click “Submit Order”. After that, you will receive an email from us confirming receipt of your order (“Order Confirmation”). Please note that this does not mean that an order has been accepted, as your order represents an offer to us to purchase one or more products from us. All orders are subject to acceptance by us, and we will confirm acceptance by sending you a shipping confirmation email (“Shipping Confirmation”). An electronic ticket with the details of your order will be attached to the Shipping Confirmation (“Electronic Ticket”). The contract between us for the purchase of a product (“Contract”) is only formed when we send you the Shipping Confirmation.

5.3. The Contract will only refer to the products listed in the Shipping Confirmation. We will not be obliged to deliver any other product that has been or could have been part of your order until the dispatch of that product is confirmed by a separate Shipping Confirmation.

VI – PROCESSING OF PERSONAL DATA

6.1. Placing an order and/or creating an account on the site involves the processing of the User’s personal data.

6.2. Personal data protection is regulated by General Data Protection Regulation no. 679/2016 (GDPR). Detailed information about personal data protection is available in the Privacy Policy.

6.3. The site uses cookies. Detailed information about data collected through cookies is available in the Cookies Policy.

VII – SERVICE AVAILABILITY

7.1. All product orders depend on their availability in our stock. In case of supply difficulties or if the products are no longer in stock, we reserve the right to inform you about alternative products of equal or superior quality and value, which you can order.

7.2. The products offered on the website www.altgust.ro are available for delivery only within Romania.

VIII – REFUSAL TO PROCESS AN ORDER

8.1. Although we make every effort to process all orders placed, there may be exceptional circumstances that require us to refuse to process an order after sending the order confirmation message, and we reserve the right to do so at any time.

8.2. We will not be liable to you or any third party for removing any product, for removing or modifying any material or content, or for not processing an order after sending the order confirmation message.

IX – DELIVERY AND RETURN OF ORDERS

X – PRICE

10.1. All prices displayed on the site are expressed in Romanian lei, RON.

10.2. Prices are final and include VAT but do not include delivery costs, which will be added to the total order amount.

10.3. Prices may be revised at any time. However, no change will affect an order for which an Order Confirmation has already been sent before the price adjustment.

XI – PAYMENT AND REFUND

XII – TRANSFER OF RISK AND OWNERSHIP OF PRODUCTS

12.1. The ownership rights to the products will transfer to the Buyer only after the Company receives full payment of all amounts due for the products, including delivery costs, or upon delivery, if this occurs at a later date. The legal right of ownership of the products will immediately revert to the Company in case of reimbursement of any such payment.

12.2. All risks related to the products (including loss and damage) will be transferred to the Buyer upon delivery, when the Buyer or a third party designated by the Buyer, other than the courier, takes physical possession of the products.

XIII – INTELLECTUAL PROPERTY

13.1. The Company respects intellectual property rights and asks Users to do the same.

13.2. The content of the site is protected by copyright and other laws. Users must respect these rights and not use the content of the site for commercial purposes without the Company’s consent.

XIV – WAIVERS AND ASSIGNMENTS

14.1. The failure of the Company to take immediate action to enforce a right does not constitute a waiver of that right.

14.2. If a provision of the Terms and Conditions is invalid, the other provisions remain valid.

XV – LIMITATION OF LIABILITY

15.1. The Company provides the site “as is” and does not provide warranties regarding the availability or operation of the site.

15.2. The Company is not responsible for inaccurate personal data provided by Users.

XVI – APPLICABLE LAW AND COMPETENT COURT

16.1. The Terms and Conditions are governed by Romanian law.

16.2. Any dispute shall be settled amicably or by the competent Romanian courts at the seller’s headquarters in Iași.

XVII – CHANGES TO THE TERMS AND CONDITIONS

17.1. ALTGUST S.R.L. reserves the right to update the Terms and Conditions at any time.

17.2. Users are advised to periodically check the Terms and Conditions section for any changes.

17.3. In the event of changes affecting Users’ rights, they will be notified by email.

17.4. If the User does not wish to accept the new changes, they must stop using the site.
